		<description>So I requested a refund from MWeb for the downtime, as per my article above, and this is the response I got from them:

"With regards to refunds, we can not compensate any clients for down-time. We will do our best to ensure access to the network at all times however we can not guarantee 100% up-time for the network as we rely on upstream providers to provide the ADSL service or certain portions thereof.  This is not unique to MWEB and very much an industry standard.
 
We refer to points 8.1 and 8.2 as set out in our ADSL terms and conditions.
 
8.1 We may use or rely on upstream providers to provide the ADSL Service or certain portions thereof. We accordingly provide the ADSL Service subject to the limitations and terms imposed on us by such upstream providers, which includes the actual availability of the upstream provider’s network.
 
8.2 We will always try to provide the ADSL Service to the best of our ability. However, we provide the ADSL Service “as is” and “as available” and do not warrant or guarantee that the ADSL Service is free of errors or interruptions, is always available, is fit for any purpose, does not infringe any third party rights, is secure and reliable, or will conform to your delivery timeline requirements.

Please also note, the outage on the international bandwidth is a fairly serious break and a number of ISP’s that have been affected by it."

How convenient that they refer to their T&#38;C to get them out of trouble and use it as a tool to abdicate all responsibility. Again this smacks of capped service delivery.</description>
